March 12, 2025. We would like to inform you of significant updates regarding new tariffs imposed by the Government of Canada on certain products imported from the United States. These measures are effective as of March 13, 2025, in response to recent U.S. tariffs on Canadian goods. Additionally, the Canada Border Services Agency (CBSA) has issued Customs Notice 25-11, outlining important regulatory changes that may impact your import and export activities.
Key Updates
New Tariffs on U.S. Goods
- Effective Date: March 13, 2025, at 12:01 a.m. Eastern Daylight Time (EDT).
- Tariff Rate: A 25% surtax will be applied to a wide range of products originating from the United States.
- Total Impact: The tariffs will affect $29.8 billion worth of U.S. imports.
These tariffs apply to goods that are eligible to be marked as U.S. goods under the Determination of Country of Origin for the Purposes of Marking Goods (CUSMA Countries) Regulations. The tariffs will remain in effect until the United States removes its tariffs on Canadian steel and aluminum products.
Exemptions and Special Provisions
- Goods in transit to Canada on the enforcement date are exempt.
- Goods classified under specific tariff items in Chapter 98 and Chapter 99 of the Customs Tariff may be exempt, with certain exceptions.
- A complete list of affected goods and exemptions is available in the Schedule to the United States Surtax Order (2025-1).
Proof of Origin Requirements
- Importers must provide proof of origin for all goods subject to the surtax, as per the Proof of Origin of Imported Goods Regulations.
- Failure to provide adequate documentation may result in surtax application and potential penalties.
Duties Relief and Drawback Programs
- The CBSA’s Duties Relief and Duty Drawback Programs are available for surtax paid or payable, subject to the provisions of CUSMA.
- Importers are encouraged to review eligibility and application requirements.
