Surtax & Goods Subject to Remission of Countermeasures on Certain Steel and Aluminum Goods from the U.S.

Buckland has received notice from the Canada Border Services Agency (CBSA) of an order imposing a surtax on the importation of certain steel goods including:

These surtaxes will come into force on October 25, 2018. A full version of the notification is available online here: Customs Notice 18-17.

In addition to this, a remission order was also released by the CBSA which allows for the remittance of surtaxes on steel and aluminum from the US which took effect on July 1, 2018.

Following this notice (Customs Notice 18-16), the CBSA has confirmed the following regarding the possible refund/remission of the surtax on certain goods:

  1. When claiming a refund or using the remission, OIC 18-1272 is quoted.
  2. Not all goods originally subject to surtax are eligible for a refund or remission. Schedule 1 of eligible goods lists both the tariff item and a description of goods. It is only the goods described that are eligible for a refund or remission.  For example, although all goods of 7208.51.00 were subject to surtax, the only goods that are subject to a refund or remission are those for production of large diameter line pipe of grade X65 or X70 (API 5L) and those of grade HPS 70 W. All other goods, despite being properly classified under tariff item 7208.51.00, continue to have the surtax applied.
  3. A reminder: this is a global remission. One does not have to apply to Finance in order to use 18-1272.
