These amendments, issued by President Donald Trump, revise the provisions for duty-free de minimis treatment under 19 U.S.C. 1321 for certain eligible articles.
Key points of the amendments include:
- Duty-free de minimis treatment will be available for eligible covered articles.
- This treatment will cease upon notification by the Secretary of Commerce to the President that adequate systems are in place to fully and expeditiously process and collect applicable tariff revenue.
- Goods that are compliant with the U.S.-Mexico-Canada Agreement (USMCA) will be exempt from these tariffs starting immediately and lasting until April 2.
These amendments aim to strengthen the measures against the influx of illicit drugs while ensuring that the necessary systems are in place to manage tariff revenue effectively.
